Tort Claim Filing

If you were injured or your property was damaged and you believe a Washington State agency or employee is at fault, you may file a Tort Claim. This is the first step in asking the state to review your situation and consider compensation for your losses.
What you’ll need to provide in the Tort Claim Form:
  • Date, time, and location of the incident

  • A detailed description of what happened

  • The type of injury or damage you experienced

  • Names of any state employees involved and any witnesses

  • Supporting documents (such as medical records, repair estimates, or photos)

Important:
You must file a Tort Claim before you can take legal action against the state. Claims are typically required to be filed within 3 years of the incident—so don’t delay.
Please note that filing a claim does not guarantee payment. Your claim will be reviewed and investigated before any decision is made.
