In checking the I agree, understand box, the requesting applicant agrees that, to the fullest extent of the law, they shall indemnify, hold harmless and defend Mountain View Fire & Rescue (“MV&R”), its employees and agents against any and all claims, demands, suits, actions, payments and judgments, including any and all expenses, legal or otherwise incurred by MV&R or its representatives, that arise from or relate to any act or omission of the requesting applicant, its agents, guests or employees on or about MV&R's facilities.MV&R shall not be responsible for any lost, damaged or stolen property. The requesting applicant further agrees to reimburse MV&R for any damage arising from the applicant's, its agent's, guest's or employee's use of MV&R facilities, and to strictly adhere to MV&R rules while on MV&R property as outlined in the attached Use of Meeting Room Policy.I have read, understand and agree to comply with MV&R's policy concerning the use of its facilities and procedures concerning use of the meeting rooms at MV&R. *
1. PURPOSE
The purpose of this policy is to provide a guideline and procedure for the useof fire station meeting rooms by external groups and/or persons.
2. POLICY
The District wishes to make the meeting/class room available to nonprofitorganizations and groups in and from the community. In some instances, thismay include supporting the delivery of community-based services. Further,the intent is to provide this service in a way that has minimal negative impacton District operations, is convenient for and fair to user groups, and preservesthe integrity of the facility and its furnishings
3. PROCEDURE
3.1. Available Rooms
The meeting/class rooms are available in its entirety for large groups (up toMaximum occupancy load).The hours of availability are typically 9 AM to 10 PM; usebeyond theses hours may be allowed on a case by case basis. Tablesand chairs are provided in the rooms.
3.2. Intended Use
3.2.1. The general intent is to provide an occasional meeting place forcommunity groups such as homeowner associations, service clubs,youth athletic groups, and the like. Acceptable uses will fit with andnot disrupt the routine activities of an active fire station. No fund-raising events where admission is charged shall be conducted. Classesrequiring a tuition or fee may be offered by approved groups on acase by case basis.
3.3. User Groups
User groups must be nonprofit groups that specifically involve and/ordirectly serve the citizens of the Fire District. The District reserves theright to determine whether a group qualifies. Fire District facilities will not be used for any political rallies, fund-raisers, seminars or meetings. Facilities may not be used for any purpose that conflicts with the policies, procedures, guides, general orders or other rules and regulations of the District.
3.4. General Guidelines for Use of the Meeting/Class Room
3.4.1. Reservations - Reserving meeting/class rooms is donethrough the District web page (www.mvfire.org). A request must be completed, submitted and approved before a reservation is effective.A reservation can be made no more than 60 days in advance.Groups wishing to use the room on an ongoing basis (such as for aMonthly home owners meeting) may request dates up to six months in advancebut will be considered tentative until inside the 60 day window. Topromote the accessibility of the room to a wide variety ofcommunity organizations, the District may limit the number ofmeetings of any particular organization. Routine Fire Districtactivities will have priority. Emergency needs of the Fire District will have priority in all cases and reserved rooms may be canceled without prior notice.
3.4.2. Service Reservations – agencies and/or organizations providingdistrict approved service deliveries (e.g.: city and county) mayrequest dates for a calendar year block to better allow for publicnotification of scheduling. Despite the length of the reservation, aRoom Use Request must be completed, submitted, and approved before the reservation is considered valid.As in the case of group reservations, any emergency needs of theFire District will have priority.
3.4.3. General Use ProceduresUpon concluding use of the room, the building must be lockedand secured. Users are responsible for maintaining the room in a neat andorderly condition. After use, basic cleaning shall be done asneeded (supplies and equipment provided). Furniture shall beleft set up as it was found. Windows shall be closed, lightsturned off, and each of the outside doors locked if required.
Children must be adequately supervised.Items may not be hung from the walls or ceilings except wheredevices are in place for such purpose.Users are responsible for maintaining discipline and order.Users are responsible for any room or furnishings damagecaused by their use.Attendance shall not exceed the posted capacity of the room.No smoking is allowed in the building.No alcoholic beverages are allowed in the building.No marijuana or its byproducts or substances containing marijuana are allowed.No gambling is allowed in the building.No candles or any open flames are permitted.No activities that conflict with District Policy, State, Local or Federal Law are allowed. No animals, other than service animals are allowed without prior approval. The District reserves the right to enforce each procedural guideline;up to and including evicting individuals and/or the entire group andthe forfeiture of room use fee(s).
3.4.4. Charges. The District has the ability to determine fees asappropriate for individual service uses based on specificcircumstances, needs, and uses and/or to recover direct or indirect costs thatmay be associated with any part of district properties, equipment, personnel or other costs to the district.
3.4.5. Parking. For events in the classrooms, attendees may park in the provided lot or in designated street parking. At no time shall any parking interfere withdistrict operations or cause a dangerous situation to exist.
4. District Rights
The Board of Fire Commissioners and/or Fire Chief retains the right to change, add or amend any and all rules, regulations or requirements for the use of district facilities at any time based on the interest of the district and the services the district provides.
